The terms for using Caylem, including your responsibilities and the rights that remain yours.
1. Who these terms apply to
These terms govern your use of the Caylem website operated by Lyemac (Pty) Ltd, a company registered in South Africa under registration number 2020/841446/07, based in Pretoria, South Africa. By using the website, you agree to these terms. If you act for a business, you must have authority to bind that business. You must be legally able to enter this agreement. If you do not agree, do not use the service.
2. What Caylem provides
Caylem provides a TypeScript application foundation, documentation, and related source materials. It is a starting point for building software. You are responsible for configuring, testing, securing, and maintaining your own application, including compliance with laws that apply to your business and users. Hosting, implementation work, support commitments, and third-party service fees are included only if expressly agreed.
3. Accounts and acceptable use
Keep your account credentials secure and provide accurate information. Do not access another person’s account, bypass purchase checks, interfere with the service, introduce malware, or use the service unlawfully. Report suspected unauthorized account access to Lyemac. Restrictions on accessing our hosted service do not restrict rights granted by the source code license.
4. Purchases and delivery
A one-time snapshot purchase covers the exact release and entitlement identified before checkout. Future releases are separate purchases unless the offer expressly includes them. The checkout displays the applicable price, currency, taxes, and payment conditions. Polar handles checkout and payment, and its applicable buyer terms also govern that transaction. After payment confirmation, the purchased release becomes available in your Caylem library for browsing and download. Contact us if payment succeeds but access does not appear. Keep your receipt and a backup of downloaded source.
5. Subscriptions
A snapshot purchase does not create a subscription. An updates subscription includes the latest and all available earlier snapshots while active. The catalog and checkout show its price and billing interval. It renews automatically until canceled through the billing portal in your library. Canceling stops renewal; access continues until the paid period ends. After expiry, subscription access ends, while downloaded ZIPs and separately purchased snapshots remain yours under the source license.
6. Cancellations, refunds, and faults
Email Lyemac at jason@lyemac.co.za with your order reference to request cancellation, a refund, or help with a faulty or missing download. Do not include card details. Applicable consumer law and the purchase terms determine your remedies. Nothing here excludes a mandatory cooling-off period, refund, repair, replacement, or other statutory right. Accessing a download does not by itself waive a right that requires separate express consent or acknowledgment. Refunded or reversed purchases may lose hosted library access, subject to your legal rights.
7. Source code and intellectual property
Caylem source distributed with the MIT License is governed by that license. It permits commercial use, modification, redistribution, and sale, provided its copyright and license notice are preserved. These website terms do not replace, narrow, or revoke those permissions. Third-party dependencies retain their own licenses. Lyemac’s names, logos, and branding do not grant permission to imply endorsement or impersonate us.
8. Your content and connected services
You retain rights in material you submit and must have permission to provide it. You permit us to process that material only as needed to provide and protect the service and comply with law. External services have their own terms, charges, and availability. You are responsible for accounts and credentials used in applications you build from the source.
9. Availability and responsibility
We aim to keep the website available, but maintenance, faults, and third-party outages can interrupt access. We do not promise uninterrupted operation or a particular business outcome. Source code warranties and liability are addressed by its license. For the website and related services, any exclusion of implied warranties or liability applies only to the extent allowed by law. Nothing excludes liability that cannot lawfully be excluded, including applicable consumer guarantees, fraud, or intentional misconduct.
10. Suspension and ending use
You may stop using the website at any time. We may restrict access where reasonably necessary to address unlawful use, security risks, or a material breach. Where practicable, we will give notice and an opportunity to resolve the issue. Suspension does not remove statutory remedies or rights already granted under an applicable source license.
11. Privacy
Our Privacy Policy explains how we handle personal information. Using this website is not consent to optional marketing or tracking. Any required consent is requested separately.
12. Changes and disputes
We may update these terms for future use and will communicate material changes as required by law. Changes do not retroactively alter a completed purchase or its source license. South African law governs these terms, subject to mandatory protections and court rights that apply where you live. Contact Lyemac first if you wish to resolve a concern informally. This does not prevent you from contacting a regulator or exercising legal rights.
